Some Odd Moves By The FDA On Vaping in June

One of the things we like to do at Smoke and Vape Tokz Smoke and Vape Shop is to make sure that our customers know what is going on with regulations in the vaping industry. While most of the blogs we’ve published in the last few years have been more doom and gloom than anything else, this month, we’ve seen some odd moves by the FDA regarding vaping.

If you recall, back in 2022, when the FDA demanded that all vaping manufacturers submit applications for marketing approval, JUUL was one of the first to do so and one of the first to be denied. The FDA stated that JUUL “lacked sufficient evidence regarding the toxicological profile of the products to demonstrate that marketing of the products would be appropriate for the protection of the public he”lth.” Obviously, JUUL was the poster child for the “teen vaping epidemic,” which made it an easy target for not only the FDA but for every anti-vaping group. Now, in 2024, the FDA has suddenly and surprisingly reversed its decision and is now allowing JUUL products market approval. While it may be too late for JUUL to regain the market dominance it once had, it is a good sign that the FDA is being put in its place to restrict less harmful tobacco-free nicotine options. There have been rumblings that JUUL is working on a 2.0 version of its devices, but not much is known about if and when they will be released.

Next up is the surprising market approval of 4 methol vaping devices, which the FDA had previously considered banning all menthol cigarettes and tobacco products. Granted, the FDA only approved menthol vaping devices from Njoy, which is certainly not very popular in the vaping community and is owned by a big tobacco entity, Altria. With the FDA’s continued crusade on banning all flavored vapes and vape liquids, it seems to us that this is an odd play that came out of left field. Maybe this is a sign of more flavored vaping products to be approved, or maybe it’s the FDA working in tandem with big tobacco, which is not uncommon.
